RAIN 4/28: Broadcasters, small webcasters face April 30th royalty deadline

Posted on: 04/28/2009

LOTS OF WEBCASTERS, B’DCASTERS STILL UNCLEAR ON RECORDKEEPING, SAYS OXENFORD

This Thursday, April 30th, is an important royalties deadline for two classes of webcasters, as attorney and webcasting royalties expert David Oxenford reminds readers in his blog.

Thursday April 30 is the deadline for broadcasters who plan to stream under the terms of the NAB/SoundExchange deal to pay any back royalties they owe for streaming from 2006 through the date of the agreement. This Thursday is also deadline for very small webcasters to notify SoundExchange they elect to stream under SoundExchange’s “unilateral” small webcaster royalty deal.

In his blog, Oxenford reports that lots of operators who are agreeing to these deals aren’t aware of the “full census” reporting requirements. He writes, “Both the small webcasters’ agreement and the NAB-SoundExchange settlement (make it necessary for operators to report)… information for every song — including the name of the song that was played, the featured artist who performed the song, the album on which the song appeared, and the label on which the album was released. In addition, the webcaster must report on the number of times each song was played, and how many people heard each transmission of the song.

For more details on the terms of the deals and of full census reporting, read Oxenford’s Broadcast Law Blog post here.

TRITON DIGITAL TO REP JETCAST’S REPLACEADS

Triton Digital has announced a deal with Jetcast that will have the Triton Sales team selling in-stream ad inventory on JetCast’s ReplaceAds Network. The ReplaceAds network is almost 5000 online radio and television content providers with more than a million daily listeners.

RECIVA-BASED NET RADIOS ADD PANDORA

Reciva, which provides tuning software to manufacturers of Internet radio devices, has announced that it will support Pandora connectivity for certain devices. This includes the Livio Radio (pictured) we covered in RAIN here. According to a CNet blog, a total of ten Reciva devices, also including Wi-Fi radios from C. Crane, Grace Digital, Sonoro Audio, and Tangent Audio, will now support Pandora. More here.

SEEQPOD MAY BE ACQUIRED BY NEW MEDIA COMPANY

SeeqPod, currently in danger of being sued into oblivion by record labels, may be acquired by a new media company that CEO Kasian Franks says is large enough to convince labels to license music played on SeeqPod, rather than simply sue the site. Find more on the story at Wired here.

8BIT FM LAUNCHES WITH VIDEO GAME FRIENDLY FORMAT

Mnemosyne LLC has launched streaming radio station 8-Bit FM which features music from video games, “nerdcore hip-hop,” and songs composed (and played) on retro video game hardware (Nintendo NES anyone?) in an apparently emerging genre called “chiptunes.” A unique format to say the least. “We felt it was high time chiptunes were available on Internet radio”, says Julia Hiroko Howe, founder of Mnemosyne. “For over 10 years, talented artists worldwide have been repurposing their old gaming hardware into bona fide sound gear.” Check out the radio station (and its eye-pleasing minimalist retro design) here.
