RAIN 10/14: Webcast license now requires reporting every song and number of listeners 24/7/365 ·Oct 14, 12:30 PM CRB REQUIRES “FULL CENSUS” MUSIC REPORTS FOR MOST WEBCASTERSIndustry legal expert David Oxenford reports today the Copyright Royalty Board is ordering most digital music services to provide a 24/7/365 account of every song played plus number of listeners for each played song as part of their royalty obligation.
The new reporting requirement will not affect webcasters that reached settlement agreements with SoundExchange that include specific reporting rules (including the “NAB” settlement and the noncommercial “educational” and “religious” settlements). Also excluded are services where “per performance reporting” isn’t possible (e.g. satellite radio, because it’s not possible to determine the exact number of listeners). Finally, Oxenford explains that small broadcasters eligible to pay only the minimum $500 annual performance royalty may continue the “two weeks every quarter” reporting. Previously, webcasters and other digital music services were only required to provide that information for two weeks each quarter. The CRB’s decision was published in the Federal Register today and is the result of the Notice of Proposed Rulemaking (see coverage here). Now, non-subscription webcasters (who aren’t in the exempted groups above) will have to provide SoundExchange with the song title, featured artist, and either the ISRC code (here) In previous discussions of reporting rules, some have questioned SoundExchange’s — by the admission of its own directors a small and lean outfit — ability to process what will surely be an avalanche of data documenting millions upon millions of listener-hours of music use. APPLE REPORTEDLY ENABLING FM-TUNER IN iPHONEThe ever-grinding Apple rumor mill has some grist today that’s of interest to radio: “We’ve just received a tip that an iPhone radio.app is being developed in-house by Apple for use on the iPhone and iPod touch,” writes rumor site 9to5Mac.com. “From what we know, the app will be allowed to operate in the background like iPod.app and will offer the same functionality as the FM radio in the new iPod Nanos.”
Interestingly, the iPhone and the iPod Touch already have the hardware to receive FM radio signals, as FM is used for the “Nike+” system (explained here). The site reports Apple is still working on integrating the Mobile iTunes Store purchases (that is, the live “song tagging” which enables a listener to select and purchase a song download as they hear it) into the functionality of the program. Again, this is a current feature of the FM tuner on the iPod Nano. What remains to be seen is whether the tuner on the iPhone would also enable “live pause” of the FM stream like the Nano. MCINTYRE NAMED VP OF CBS INTERACTIVE MUSIC GROUPFred McIntyre has been named Vice President of Product for the CBS Interactive Music Group, the company announced yesterday. The business unit, launched in May, includes CBS Radio’s web sites, mobile platforms and Last.fm. He will report to CBS Interactive Music Group President David Goodman. McIntyre’s resume includes positions with AOL, SPIN and Vibe magazines and Internet radio pioneer Spinner.com. While at AOL, he built and led AOL’s global product businesses for AOL Video, AOL Radio, SHOUTcast and Winamp.
