OXENFORD: NYT FAILS TO MAKE CRB CONNECTION IN STORIES ON RADIO ROYALTIES, PANDORA’S STRUGGLE

Industry attorney David Oxenford points out how The New York Times yesterday — in articles just a page apart — aired the grievances of the record industry and performers calling for a broadcast radio royalty on song recordings, and described how performance royalties nearly killed the popular (and, reportedly, beneficial-to-record-sales) webcaster Pandora (and all of webcasting, for that matter).

“The article about the broadcast performance royalty (The New York Times, here) mentions that one of the difficulties in assessing the impact of the proposed royalty is that no one knows how much it will be, as it would be set by the Copyright Royalty Judges on the CRB,” Oxenford writes. “Yet the Times makes no mention of the controversy over the previous decisions of the Board in the context of the Internet radio royalties, and how such royalties almost impacted services such as Pandora.” (See RAIN‘s coverage of this story yesterday, here.)

Oxenford explains that previous CRB decisions using the “willing buyer, willing seller” standard (which both the House and Senate versions of the Performance Royalty Act — the bill that would impose performance royalties on broadcasters — call for) have not mandated less than 15% of gross revenues.

EMMIS INTERACTIVE INKS DEAL WITH ASTRAL RADIO; REDESIGNS WEBSITE

Emmis Interactive — which provides software and consulting services for local radio — has signed a long-term deal with Canada’s Astral Media Radio. Emmis Interactive will provide its interactive platform and sales consulting “as part of Astral Radio’s renewed emphasis on building out its Interactive business.” Astral Media Radio operates 82 licensed radio stations across Canada including major markets like Toronto, Vancouver, and Montréal. Astral Media Radio brands include NRJ, Rock Détente, Boom FM, Virgin Radio, CJAD and CHOM.

Emmis Interactive also announced the redesign of its website, EmmisInteractive.com.

JELLI SYNDICATES NEW SHOWS FOR ROCK AND POP FORMATS

Crowd-sourced radio platform Jelli (latest RAIN coverage here) has begun syndication of its two newest programs, Rock Jelli and Pop Jelli. Jelli programming will air on 10 new FM stations: WBOS/Boston, WPST/Philadelphia, KXTE/Las Vegas, WJBX/Fort Myers, WJLK/Jersey Shore, WKRL/Syracuse, WKLL/Utica, KISN/Bozeman, KBAZ/Missoula, and KTRS/Casper. D.C.‘S “THE FANUSES HD SIDE CHANNELS TO OFFER ACCESS TO SPORTS TALKNETWORK

CBS Radio’s sports talk WJFK-FM/Washington, D.C. has become the nation’s first HD Radio “quadcast,” as its three HD “side-channels” are now CBS sports talk stations from other major Northeast markets. “The FAN Sports Network,” accessible to HD Radio owners in the D.C. area, now includes programming from Baltimore’s WJZ-FM (HD2), New York’s WFAN (HD3) and Philadelphia’s WIP (HD4).

PANDORA APPOINTS STEVE CAKEBREAD AS NEW CFO

Pandora announced yesterday the hire of Steve Cakebread as new Chief Financial Officer. He previously served as the president and chief strategy officer of Salesforce.com, a customer relationship management service provider. Cakebread was with Salesforce.com during its IPO — interesting in that some investment bankers have called Pandora a likely candidate to go public soon (RAIN coverage here).
